Description of goods and/or services

VSQ2 (PTY) Ltd trading as BOSKAR © Original is an original equipment manufacturer (OEM), distributor, and seller of robust, versatile, modular, and quality vehicle accessories for adventurous, challenging, or extreme conditions and terrains.

Terms and conditions

Any quotation, proforma invoice, invoice, acceptance of an order, and subsequent sales transactions are subject to the full text of VSQ2 (PTY) Ltd terms and conditions.

Order policy

The provision of products and services by BOSKAR © Original is subject to product availability. In cases of product unavailability, BOSKAR © Original will confirm the time to manufacture to the ordering party.

Quotes will attempt to reflect the estimated delivery date of the next shipment of the specific product. ETA dates are not guaranteed as upstream material or component suppliers may not always have stock available to support manufacturing.

BOSKAR © Original will attempt to honour all orders within three (3) business dates from of receipt of payment.

Delivery policy

Subject to receipt of payment, product orders will be processed within one (1) business day. The ordering party will receive an accounting and or tracking confirmation message.

BOSKAR © Original uses various methods of delivery, including commercial courier services, such as the ‘The Courier Guy;’ BOSKAR © Original cannot be held liable for late deliveries by third-party commercial courier services.

Goods received policy

SIGNATURE RECEIVED BY ANY RECIPIENT UPON DELIVERY, WHETHER QUALIFIED OR NOT WILL BE TAKEN AS PROOF OF RECEIPTS OF GOODS.

By signing an invoice, the recipient acknowledges that the quantities stipulated have been verified, and that the condition of the packaging and contained product is satisfactory. Invoices marked ‘Not Checked’ will not be accepted, and no claims other than warranty claims against the invoices will be processed.

Further distribution and or resale policy

BOSKAR © Original recommends the inclusion of equivalent quote terms and conditions, where applicable, when quoting or invoicing customers if distributing and or reselling BOSKAR © Original products.

Export restrictions and resale policy

The BOSKAR © Original products on its website and other sales channels typically is available to the entire world. However, BOSKAR Original’s © focus is primarily on the South African market and secondary to Mozambique, Zimbabwe, Botswana, Namibia, Angola, and Zambia.

BOSKAR © Original has no restrictions on exports on its products.

Return and refunds policy

Cancellation of orders by the ordering party will attract a five percent (5%) administration fee, or for any goods returned.

BOSKAR © Original will refund the ordering party, minus the administration fee, within two (2) working days of receipt of returned goods from the order cancelling party.

Warranty

BOSKAR © Original warrants its products to be free from defects in materials and workmanship under normal use for a period of one year. Except as specifically stated herein, all express or implied warranties whatsoever, statutory, or otherwise, including without limitation, any implied warranty of merchantability and fitness for a particular purpose, are expressly excluded.

Because BOSKAR © Original probably will not be the ultimate installer of its products and because the products may be used in conjunction with products not manufactured by BOSKAR © Original, BOSKAR © Original may not be able to guarantee the performance of its products under all possible non-OEM variables and shall not be responsible for circumstances resulting from the product’s inability to operate under such non-OEM variables and/or conditions.

BOSKAR © Original’s obligation and liability under this warranty is expressly limited to repairing or replacing, at BOSKAR © Original’s option, any product not meeting the specifications. Returns must include proof of purchase and be within the warranty period. In no event shall BOSKAR © Original be liable to the buyer or any other person for any loss or damages whether direct or indirect or consequential or incidental, including without limitation, any damages, or claims by any other party, caused by defective goods or otherwise arising from the improper, incorrect or otherwise faulty installation or use of the products.

Notwithstanding the preceding paragraph, BOSKAR © Original’s maximum liability will be strictly limited to the purchase price of the defective product. Your use of this product signifies your acceptance of this warranty.

NOTE: Dealers, installers and/or others selling the product are not authorized to modify this warranty or make additional warranties that are binding on BOSKAR © Original.

Specifications may change without prior notice.

Customer privacy policy

BOSKAR © shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to
Information Act 2 of 2000 (PAIA).

Payment options accepted

Payment may be made via Visa and MasterCard via ZAPPER on the online sales channels. Otherwise, standard commercial banking electronic funds transfers will also be accepted for orders.

Cash options may be available for on site product purchases and installations, or special events product purchases and installations.

Card acquiring and security

Card transactions will be acquired for BOSKAR © Original via ZAPPER, an approved payment gateway for all South African Acquiring Banks.

ZAPPER uses the strictest security and encryption standards for transactions, ensuring all card payments are secured up to PCI DSS Level 1 standards, and with tokenisation of card information with VISA ad MasterCard.

No card details are stored on the website.

Customer details separate from card details

Customer information entered by the customer will be stored by BOSKAR © Original on the site https://boskar.co.za, but such information is stored separately from the customer card details ZAPPER’s secure payment site.

Merchant outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.

Transaction currency is South African Rand (ZAR).

Responsibility

BOSKAR © Original takes responsibility for all aspects relating to the transaction including sale of goods and services sold on its sales channels, customer service and support.

BOSKAR © Original does not take responsibility for disputes between clients and courier companies, or 3^rd party distributors of BOSKAR © Original products.

Country of domicile

BOSKAR © Original, as well as its sales channels, are governed by the laws of South Africa and BOSKAR © Original sets as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of any nature, as the address of 103 Sunset Drive, NOOITGEDACHT, 1747.

Variation

BOSKAR © Original may, in its sole discretion, change this agreement or any part thereof at any time without notice.

VSQ2 (PTY) Ltd business VAT registration

VSQ2 (PTY) Ltd is not registered for VAT as of yet.

VAT legislation requires small businesses to register for VAT only if it’s the taxable supplies are over R1 million over 12 months. While a business may register for VAT voluntarily if its annual taxable supplies exceed R500,000 in 12 months, VSQ2 (PTY) Ltd has not yet reached the voluntary value of R500,000 in 12 months.

Should VSQ2 (PTY) Ltd reach the voluntary value of R500,000 in 12 months, it will register for VAT and the VAT number will appear on all invoices, quotes, and purchase orders.

All VSQ2 (PTY) Ltd invoices will not have an included VAT number and such invoices should not be considered as complete VAT invoices.
